1. Who operates this Site
The Site is owned and operated by Texas Sports Marketing, a division of MC&O Inc. (“TSM,” “we,” “us”). Texas Sports Marketing holds the media and audio streaming rights for Lubbock Independent School District (“Lubbock ISD” or the “District”) athletics and produces the broadcasts available on this Site under those rights.
This Site is not owned, operated, or maintained by Lubbock ISD. The Site is independently produced and operated by TSM. The District does not control, review, or endorse the content published on this Site, and the District is not responsible for the Site or your use of it.
2. Use of the Lubbock ISD name and marks
The “Lubbock ISD” name and the names, logos, and marks of Coronado High School, Lubbock High School, Monterey High School, and Estacado High School are the property of Lubbock Independent School District and are used on this Site with the District’s permission. Links from this Site to the District’s website and to individual school websites are provided for informational purposes only and do not imply that the District operates or endorses this Site.
3. Third-party sites and services
The Site links to and embeds services we do not operate — including the Lubbock ISD district website, KCBD / MyLubbockTV, LISD-TV, HomeTown Ticketing, Rank One, NFHS Network, ScoreStream, YouTube, and social media platforms. These links and embeds are provided solely for your convenience and information. TSM does not control and is not responsible for the content, accuracy, availability, policies, or practices of any third-party site or service, and a link does not constitute an endorsement. Your use of third-party sites is at your own risk and subject to their own terms and policies. Tickets, in particular, are sold by HomeTown Ticketing, not by TSM.
4. Content disclaimer
Schedules, kickoff times, venues, and broadcast availability are subject to change without notice, and we make no promise that any particular game will be broadcast. Scores displayed in the fan scoreboard are reported by fans through ScoreStream and are unofficial. All content on the Site is provided for general informational and entertainment purposes. While we work to keep information current and accurate, the Site and all of its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.
5. Your use of the Site
You may use the Site for personal, non-commercial purposes as a fan. You agree not to: (a) record, rebroadcast, redistribute, or commercially exploit any audio or video stream from the Site without our written permission; (b) interfere with or disrupt the Site, its servers, or its streams; (c) attempt to gain unauthorized access to any portion of the Site; or (d) use the Site in any way that violates applicable law. You are solely responsible for your use of the Site and for ensuring that your use complies with applicable laws.
6. Intellectual property
The audio and video broadcasts, original text, graphics, and design of the Site are the property of TSM or its licensors and are protected by copyright and other intellectual-property laws. District and school names and marks are the property of Lubbock ISD (used with permission); third-party names and marks are the property of their respective owners. Nothing on the Site grants you any license to use any name, mark, or content except as needed to view the Site as intended.
7. Limitation of liability
To the fullest extent permitted by law, TSM, MC&O Inc., and their owners, employees, contractors, and partners are not responsible or liable for the content on the Site, for your use of (or inability to use) the Site, or for any decision you make in reliance on information from the Site — including schedule changes, broadcast interruptions or failures, unofficial scores, or content on linked third-party sites. In no event will TSM be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the Site. Because the Site is free, if any liability is nonetheless found, it will be limited to the maximum extent permitted by applicable law. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnification
You agree to indemnify and hold harmless TSM, MC&O Inc., and Lubbock ISD from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.
9. Privacy
Our Privacy Policy explains what information the Site collects and how it is used. By using the Site you also agree to the Privacy Policy.
10. Changes; governing law
We may update these Terms at any time by posting a revised version with a new effective date; continued use of the Site means you accept the revised Terms. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought exclusively in the state or federal courts located in Lubbock County, Texas. If any provision of these Terms is found unenforceable, the rest remain in effect.
